From 16 April 2026, new rules are in force that set clear requirements for managing methamphetamine contamination in rental homes. The Residential Tenancies (Managing Methamphetamine Contamination) Regulations (Meth Regulations) introduce consistent testing standards, clear contamination thresholds, and defined processes for decontamination and tenancy management. From 1 May 2026, a new Information Privacy Principle 3A under the Privacy Act 2020 came into force. Under IPP 3A, agencies that collect personal information indirectly from a third party must take reasonable steps to notify the individual concerned, unless an exception applies. This Q&A resource provides general guidance on how IPP 3A may apply in common real estate scenarios, including referrals, information sharing between agents or branches, online portal enquiries, and the sharing of sales information. This resource is for general informational purposes only. There is no “one size fits all” approach to complying with IPP 3A, and each situation should be assessed on its own facts. Agencies should seek independent legal advice or speak with their legal, compliance, branch manager, or supervisor contacts if they are unsure about their obligations.

Under Rule 10.2(a) of the Code of Conduct Rules 2012 (Code of Conduct), a written appraisal is required when an agent, or any licensee engaged by the agent has (or is entering into) an agency agreement with a client. In light of the recent severe weather events in the North Island, numerous properties have been damaged, and there may not be comparable sales data in the region to calculate an accurate price range for the appraisal.

REINZ has prepared optional clauses for sale and purchase agreements where a property has been (or may have been) affected by a natural disaster. This document includes a clause making the agreement conditional upon the purchaser being able to insure the property, insurance disclosure condition, professional report condition, and a framework within which vendors and purchasers can work with EQC and private insurers to see if it is appropriate to assign the vendor’s property insurance. Licensees should read the guidance carefully before using these clauses.

The clauses contained in this booklet relate primarily to the sale and purchase of business and are drafted principally to be used in conjunction with, and inserted as clauses into, the “Further Terms of Sale” section of the TLANZ (formerly ADLS)/REINZ Agreement for Sale and Purchase of a Business Fourth Edition 2008(2) ONLY and no other edition of that form. These clauses should only be inserted into other editions of the TLANZ/REINZ Agreement for Sale and Purchase of a Business form with caution and must always be used with care and discretion. Particular care should be taken to ensure that the numbering of the clause, or of any clauses referred to in the clause, are modified accordingly. If there is any doubt about the appropriateness of the clause, then the licensee drafting the agreement, or the parties executing the agreement, should take professional advice before execution. Notes have been inserted adjacent to clauses where considered appropriate, but are not to be taken as a substitute for obtaining professional advice.

We are currently in the process of creating new Best Practice Clauses for the benefit of all our members. These resources are a collaborative effort with The Law Association of New Zealand Incorporated (formerly known as Auckland District Law Society/ADLS). The Law Association of New Zealand Incorporated has established a subcommittee of property specialist lawyers who has started the drafting work of the residential and rural clauses. We are hoping to make these clauses available in 2026. Clauses in this Useful Clauses Booklet 2018 are drafted for use with the TLANZ (formerly ADLS)/REINZ Agreement for Sale and Purchase of Real Estate in 2013. The Real Estate Institute of New Zealand (REINZ) first published this booklet in 1957 under the title Bulletin on Sales Agreements and has republished several editions since.
