On 7 April 2026, REINZ made submission on the Ministry of Justice (MoJ) consultation on the AML/CFT levy proposals. In our submission, we have re-stated that REINZ and our members do not support a levy being imposed on the real estate sector for the reasons set out in our earlier submissions. If, notwithstanding our position, a levy is imposed on the real estate sector, we have asked for meaningful regulatory relief for the real estate sector and better sector-specific resources and guidance.

It is prudent to be aware of the “uninvited direct sale provisions” in the Fair Trading Act 1986 if you utilise cold calling or door knocking to find new clients and business. In addition to the Real Estate Agents Act 2008, the Fair Trading Act provide more protection for clients if an agency agreement is an uninvited direct sale. This Information Sheet contains a summary of how these Fair Trading Act provisions apply.

Under Rule 10.2(a) of the Code of Conduct Rules 2012 (Code of Conduct), a written appraisal is required when an agent, or any licensee engaged by the agent has (or is entering into) an agency agreement with a client. In light of the recent severe weather events in the North Island, numerous properties have been damaged, and there may not be comparable sales data in the region to calculate an accurate price range for the appraisal.

REINZ has prepared optional clauses for sale and purchase agreements where a property has been (or may have been) affected by a natural disaster. This document includes a clause making the agreement conditional upon the purchaser being able to insure the property, insurance disclosure condition, professional report condition, and a framework within which vendors and purchasers can work with EQC and private insurers to see if it is appropriate to assign the vendor’s property insurance. Licensees should read the guidance carefully before using these clauses.
