REINZ Privacy Policy

Introduction and scope

REINZ is committed to protecting your privacy. REINZ (we, us, our) complies with the New Zealand Privacy Act 2020 (the Act) when dealing with personal information. Personal information is information about an identifiable individual (a natural person).

This policy sets out how we will collect, use, disclose and protect the personal information we collect in connection with your:

  • membership with REINZ (or the membership of your organisation)
  • provision of information to REINZ, directly or indirectly
  • access to or use of one of our services or products, including our website
  • interest as a prospective customer or user of our services or products
  • attendance at our events
  • participation in our training programmes or qualifications as a student or trainer.

This policy does not cover our collection, use, disclosure or protection of information that we collect from REINZ staff, contractors or service providers.

This policy does not limit or exclude any of your rights under the Act or other applicable laws. If you wish to seek further information on the Act, see www.privacy.org.nz.

Changes to this policy

We may change this policy by uploading a revised policy onto the website. We encourage you to periodically review this policy, as each new subsequent policy will apply in relation to the personal information held by us.

The change will apply from the date that we upload the revised policy.

What personal information do we collect

We collect, hold and process four main categories of personal information: Membership Data, Account and Marketing Data, Education Data and Property Data.

Membership Data is personal information that we collect about you in connection with your or your organisation’s membership with REINZ, which may be collected in connection with the creation or administration of your or your organisation’s membership with REINZ.

The Membership Data we collect may include your name, date of birth, email address, home address, work address and any other contact information you provide to us, REINZ ID and REA ID numbers, job titles, employer details, and information contained in your correspondence with us and other information required to manage your or your organisation’s membership.

Account and Marketing Data is personal information that we collect about you in connection with your or your organisation’s use of, or interest in, a REINZ data product or other service and our interactions with you as a customer or potential customer, which may be collected:

  • In connection with the creation or administration of a customer account for our data products or other services, including any educational services that we provide.
  • If you ask to receive information about us or a REINZ data product or service or sign up to receive any of our newsletters or other communications.
  • When you sign up to or access or use a REINZ data product or service.
  • When you register to attend, or attend, a REINZ event.
  • When you contact us directly (e.g. telephone call, website enquiry form or email) or visit our website.

The Account and Marketing Data we collect may include your name, username, phone numbers, email addresses and any other contact information you provide to us, your location, billing information, purchase history, information about how you use our website and/or our data products or services (for example, traffic volumes, time spent on pages), your IP address and/or other device identifying data, social media usernames or handles where you choose to interact with us for social media giveaways, a photograph of you (for example, if you attend a REINZ event), information contained in your correspondence with us and other information required to provide a service or information you have requested from us.

Education Data is personal information that we collect about you relating to your participation in one of our training programmes or qualifications (either as a learner or trainer), and that is not otherwise Account and Marketing Data.

The Education Data we collect may include your name, date of birth, Government NSI number and records of prior course completions, demographic information, documentation about your identity, employment history, level of education and any specific education needs, citizenship and/or residency, immigration status, pastoral care information, course performance information (for example, assessments, grades, moderation outcomes and trainer feedback), attendance and participation records (for example, sign-in/sign-out sheets, online session logs, course enrolment and completion status), pastoral care information shared with us by your trainer to support your participation and wellbeing and if you are a trainer, any feedback given about you from course participants.

Property Data is personal information relating to property ownership, value, sale and purchase, and characteristics (such as property title data) that is provided to us by third parties such as our member agents, Toitū Te Whenua Land Information New Zealand, Ministry of Business, Innovation and Employment and local authorities (among others). The majority of our Property Data is publicly available information (available via local authorities and others), other than sales data provided to us by member agents once a sale and purchase has gone unconditional, but before settlement, which we refer to as Unconditional Sales Data.

Who do we collect your personal information from

If possible, we will collect personal information from you directly, including via our website and any related service, through any registration or subscription process, through any contact with us (e.g. telephone call or email), or when you buy or use our services and products.

In some cases, we collect information from third parties. We will only do this in cases where we believe, on reasonable grounds:

  • That you have authorised us to collect information about you from a third party (e.g. by allowing your organisation to provide us with Membership Data and/or Education Data).
  • The information is publicly available (e.g., most Property Data).
  • Collection from you directly is not reasonably practicable (e.g., we collect Unconditional Sales Data directly from our agent members and not from each buyer/seller of a property). In such cases, it is not practicable for us or anyone we supply the information to tell you that we have your information or where we obtained it from. As a buyer or seller of the property you will already know this anyway as it is the agent acting on the sale who supplies the Unconditional Sales Data to us.

How we use your personal information

We will use your personal information (other than Property Data):

  • To verify your identity.
  • To provide services and products to you.
  • To market our services and products to you, including contacting you electronically (e.g., by text or email).
  • To survey your opinion of our products and services or interest in potential new products and services.
  • To improve the services and products that we provide to you and others.
  • To bill you or your organisation and to collect money that you or your organisation owe us, including authorising and processing credit card transactions.
  • To respond to communications from you, including a complaint.
  • To conduct research and statistical analysis (on an anonymised basis).
  • To protect and/or enforce our legal rights and interests, including defending any claim.
  • For any other purpose authorised by you or the Act.
  • To facilitate your participation in a competition or promotional event which you have registered for.

We may also use Membership Data to manage your or your organisation’s membership with REINZ.

We will use Property Data to provide and improve our services and products. In particular, REINZ combines this information with other property and market information and uses it for its own purpose or makes it available to real estate agencies and valuers, and other third parties (or service providers to any of them) for the following purposes:

  • Provision of appraisals and valuations to prospective vendors or purchasers of properties in the same area as the property.
  • Publication of reports and guidance on the real estate market nationally or in particular locations.
  • Research, statistical, and predictive analysis for internal use or publication.

Disclosing your personal information

We may disclose your personal information:

  • To another company within our group.
  • To companies that we have referral arrangements with.
  • To any business that supports our services and products, including any person that hosts or maintains any underlying IT system or data centre that we use to provide the website or other services and products.
  • To other third parties (for anonymised statistical information).
  • To a person who can require us to supply your personal information (e.g. a requirement that we assist with any investigation of a REINZ Member under the Real Estate Agents Act 2008).
  • To any other person authorised by the Act or another law (e.g. a law enforcement agency).
  • To any other person authorised by you.
  • Where we need to do so in order to comply with any applicable law; protect or defend our legal rights or property or those of any member of REINZ; or protect the safety of our personnel, customers, users or the public.

We also disclose the following specific categories of information in the following ways:

  • We disclose Account and Marketing Data, Membership Data and Education Data to sector group members and ambassadors associated with REINZ to contact you to facilitate the provision of REINZ products and services or support REINZ education and training initiatives.
  • We disclose Education Data to various regulatory and government agencies to whom we have reporting requirements and other organisations which support particular students through scholarships, payment of fees or other awards.
  • Education Data may be supplied to other educational organisations for the purpose of verifying academic records.
  • Education Data provided as part of enrolment details disclosed to government agencies will be included in the National Student Index and may be used in an authorised information matching programme with the New Zealand Birth Register.
  • We may disclose Education Data relating to your course performance to your employer, if your employer is paying REINZ your course fees for administration and verification purposes.
  • We make Property Data available via our products and services to our customers. Unconditional Sales Data is only available to members of REINZ and is subject to various restrictions on use.

Businesses that support our services and products may be located outside New Zealand. This may mean your personal information is held and processed outside New Zealand but we only transfer personal information to overseas jurisdictions in accordance with the Privacy Act 2020.

We may transfer your information in the case of a sale, merger, consolidation, liquidation, reorganisation or acquisition of all or part of our business.

Protecting your personal information

We take practical and reasonable steps to secure your personal information from unauthorised access, use or disclosure. Some of these steps include:

  • Providing privacy training to our staff.
  • Ensuring there are clear internal lines of communication so that all personnel know who they can talk to within REINZ about privacy issues.
  • Maintaining security software.
  • Restricting access to your personal information to relevant individuals.
  • Imposing privacy compliance obligations in our contracts with our customers who may have access to personal information.
  • Implementing clear procedures on how to detect, report and investigate potential data breaches, including a plan for mandatory notification obligations under Part 6 of the Privacy Act 2020.

Accessing and correcting your personal information

Subject to certain grounds for refusal set out in the Act, you have the right to access your readily retrievable personal information that we hold and to request a correction to your personal information. Before you exercise this right, we will need evidence to confirm that you are the individual to whom the personal information relates.

In respect of a request for correction, if we think the correction is reasonable and we are reasonably able to change the personal information, we will make the correction. If we do not make the correction, we will take reasonable steps to note on the personal information that you requested the correction.

We may charge you our reasonable costs of providing to you copies of your personal information or correcting that information.

If the personal information that is the subject of a request for correction or deletion is Property Data, we may refer you to the third party who provided us the information to process your request.

Internet Use

While we take reasonable steps to maintain secure internet connections, if you provide us with personal information over the internet, the provision of that information is at your own risk.

Our website may contain links to other websites outside our control and not covered by this Privacy Policy. If you access other websites using the links provided, the operators of these websites may collect information from you, which will be handled in accordance with their privacy policy.

Cookies

When you visit our websites (such as www.reinz.co.nz, https://www.reinzcentreofexcellence.co.nz), we use Google Analytics to collect certain information about your visit. This enables us to assess the effectiveness of our website. Information collected includes the time, date and length of your visit, any information or documentation you download, your IP address, browser type and cookies. We also collect demographic information, such as your age, gender, preferences, interests and favourites. Cookies do not reveal your name, address, phone numbers or email address.

You can disable cookies in your browser settings without affecting your ability to use our site.
