Clouded judgement?

The complainant in this case was licensed as an Agent and was engaged by the vendor via a sole agency agreement. The complaint was made against another licensee as set out below.

The Licensee had taken purchasers (her parents) through the vendor's home when there was no agency agreement or conjunctional agreement in place

On 11 December 2017, the Licensee contacted the complainant requesting if she could take some buyers through the property. The complainant declined stating that there were already offers being presented to the vendors.

Despite being told no, the following day, the Licensee went with her parents to the property and spoke with the vendor. The Licensee informed the Complaints Assessment Committee (CAC) that this act was excusable because her parents had an ongoing relationship with the vendor given that they were selling their property to the vendor.

The CAC did not accept the Licensee’s explanation and found that she breached Rule 5.1 (exercising skill and care), Rule 5.2 (sound knowledge of the Act, Regulations and Rules), Rule 6.2 (acting in good faith) and Rule 6.3 (industry disrepute) of the Professional Conduct and Client Care Rules 2012.

The Licensee had attempted to renegotiate the terms of the Agreement for Sale and Purchase (Agreement)

The vendor accepted the Licensee’s parents conditional offer. On 12 January 2018, the complainant received a call from the vendor informing her that the Licensee had commenced renegotiations of the Agreement.

Two communications from the vendor’s lawyer to the buyer’s lawyer were sent requesting the Licensee cease and desist from contacting the vendor directly.

The Licensee stated that the vendor pressured her into discussions when she went to the vendor’s property to discuss the sale of her parent’s property to them.

The CAC stated that the pressure did not mean that she could breach her obligations and further stated that the communications evidenced that it was more likely than not that the Licensee attempted to renegotiate the Agreement and as a result, breached Rule 5.1, Rule 5.2, Rule 6.2 and Rule 6.4 (not to mislead).

The actions of the Licensee prevented the complainant from acting in the best interests of the vendor

The CAC found that the Licensee prevented the complainant from acting in the best interests of the vendor.

Finding:

The CAC, accordingly, found that the Licensee had engaged in unsatisfactory conduct.

Tips:
1. An agent should not interfere with another agent’s sole listing especially, where there is no contract permitting communication with the other party.
2. An agent who is pressured by any party should take steps to terminate any conversations or calls from that party especially, when they are not legally obliged to deal with them.

Auckland Council vote for new building fees

Auckland Council voted in favour of the proposal to increase building control and resource consent fees, which was designed to improve cost recovery and bring in an additional $662,000 in annual revenue, last week.

Bindi Norwell, REINZ Chief Executive said, "Over the last 10 years the median price of homes in Auckland has increased by 93%, from $440,000 in April 2009 to $850,000 in April 2019, and the announcement is likely to push this figure up even higher.

"We understand that the council has publicly talked about its financial difficulties and that costs do increase over time, but given that house prices in Auckland are already unaffordable for so many, this may push house prices up even further with the significant increase of some of the costs proposed."

Houses are cheaper outside Auckland

Bindi Norwell, REINZ Chief Executive said: "While Auckland's median house price has remained relatively stable over the last three years hovering around the $850,000 mark, homes are still proving to be too expensive for many – particularly first-home buyers."

She said there was a similar pattern in Wellington where the median price is now $737,500
