Translated Tenancy Information
REINZ is working alongside MBIE and will be offering members their updates on a monthly basis. This week, they update us on translated tenancy information.

Case Update: Verbal tenancy agreement enforceable or not?
The landlord in this case applied for rent arrears and termination of the tenancy.
Facts:
The landlord and the tenant had no written tenancy agreement between them. Rent was in arrears for over 21 days. The tenant vacated the property however, the landlord did not know which date the tenant actually vacated the property and keys were not returned.
Law:
Under section 13 of the Residential Tenancies Act 1986 (the Act), tenancy agreements must be in writing and the landlord must provide a copy to the tenant. The Act applies even if a tenancy agreement is not in writing, as per section 13C of the Act.
Section 55(1)(a) of the Act denotes that if rent is in arrears by at least 21 days, the Tenancy Tribunal can make an order terminating the tenancy.
Finding:
The Tribunal acknowledged that there was no written tenancy agreement between the two parties and therefore, was required to determine whether the tenant was aware of their obligations under the Act.
The Tribunal found that based on communications (email) between the landlord and tenant, the tenancy began on 9 January 2019 and as a result, the tenant was aware of their obligations by way of a verbal tenancy agreement.
The tenancy was also terminated.
