Survey of REINZ Members

REINZ will shortly be undertaking a membership survey to understand how best to support its members, to gain an understanding of compliance costs, your views on industry related issues and your views on culture and diversity.

Buyer Enquiries Over

Sometimes, the term ‘Buyer Enquiries Over’ (BEO) or similar variations are used to market a property. Terms like these give an indication of the lowest price the vendor hopes to achieve for the property.

As it is an indication only, a vendor is not obliged to accept the first offer they receive over the BEO indication. They are still free to negotiate on an offer that is over the BEO indication.

However, licensees do need to make sure a BEO indication genuinely reflects a price that the vendor will give serious consideration to. For example, advertising a property as ‘Buyer Enquiries Over $700,000’, when you know the vendor’s bottom line is $750,000, is likely a misleading use of the BEO mechanism, as well as a breach of Rules 9.4 (Licensees must not mislead customers as to the client’s price expectations) and 10.4 (An advertised price must clearly reflect the pricing expectations agreed with the client) of the Client Care Rules.

Licensees also need to be aware of Rule 10.10 (Licensees must submit all offers concerning the sale to the client, provided such offers are in writing). So, whilst you may encourage prospective buyers to offer above the BEO indication, you must still submit lower offers, provided they are in writing.


AML Vetting

Question: What staff do you need to vet?

Answer: Under section 57 of the AML/CFT Act, procedures, policies and controls for vetting staff must be included in your Compliance Programme. You need to vet any senior managers, the AML/Compliance Officer and any other employee that is engaged in AML.


ANZAC DAY TRADING HOURS

ANZAC Day is tomorrow Thursday, 25 April. Real estate agencies are not covered under the Shop Trading Hours Act 1990 and hence are not subject to the restricted trading hours on ANZAC Day. However, although the legal position allows it, we ask our members to bear in mind the special nature of this day when deciding whether to conduct open homes and auctions, e.g. after 1pm may be a more appropriate choice.

Remember also that ANZAC Day is not a “working day” under the Sale and Purchase Agreement for the purposes of calculating condition and settlement dates.

Ōtāhuhu, Henderson are top suburbs for millennials in Auckland

Recent REINZ research analysed the walking distance from supermarkets, cafes, parks and other facilities, public transport options and average house and rental prices in each area. The research used housing and rental price figures from REINZ's database and "walkability" and transit scores from sustainable transport advocacy website Walk Score.

Bindi Norwell, REINZ Chief Executive said the findings challenged the perception people had to sacrifice living close to amenities to cut rental costs.

Norwell credited places such as Papakura, Ōtāhuhu and Manurewa's proximity to train stations and affordability for their high ratings. Ōtāhuhu also received a relatively high walkability score of 88 out of 100.
