2019 RPM Conference - Thriving in Changing Times

Case Update: Infested Premises
The issue in this case was whether the tenant breached their obligations under the Residential Tenancies Act 1986.
Under Section 40 of the Act, the tenant must leave the premises reasonably clean and tidy at the end of the tenancy.
The tenant did not leave the premises reasonably clean or tidy nor did they remove all rubbish. Cockroaches had infested the premises and the premises had to be treated twice and cleaned twice. The second-hand oven had also been infested with cockroaches. The Tribunal ordered for the oven to be replaced.
The tenant failed to replace the smoke alarm batteries which breached section 9 of the Residential Tenancies (Smoke Alarms and Insulation) Regulations 2016. The tenant was ordered by the Tribunal to replace the batteries and lightbulbs as well.
The Property Management company was wholly successful in their application.
