Case Update: Tenancy Tribunal explains what is ‘reasonably clean and tidy’
Facts: The Landlord brought a claim against the Tenants for vacated damages. The Landlord claimed that the Tenants had left the property in an unsatisfactory state. The Tenants admitted that they forgot to remove a door used as a desktop but otherwise claimed that the property was clean and tidy. Both parties adduced evidence of the property.
Decision: The Tenancy Tribunal considered the question, what constitutes “reasonably clean and tidy”? The tenant is not required to leave the property in an immaculate standard of cleanliness. The standard is what an average, reasonable bystander would consider “reasonably tidy”. This standard will vary depending on the age and condition of the property.
The Tribunal did not consider a video showing the condition of the property at the commencement of the tenancy. This was not relevant to the question of the condition of the property at the end of the tenancy. The photographic evidence provided by the Tenants suggested that the property was reasonably clean and tidy. There were two exceptions to this: the carpet was not sufficiently clean, and the door was not removed. The Tribunal awarded the Landlord $120 for carpet cleaning and $50 for the removal of the door.

AML/CFT Guidance for Real Estate Agents Released
The week, the Department of Internal Affairs released its anti-money laundering guidance for the real estate industry. Updated Useful Clauses Booklet
REINZ and the New Zealand Law Society are today releasing an updated version of the 2013 Useful Clauses Booklet. The changes incorporated into this update are:
- Clauses C6 and C7 (Spa Pool/Swimming Pool Non-compliance clause and waiver by purchaser) has been updated to reflect current legislation;
- Clauses H5 – H8 (Assignment of insurance claims – Christchurch quakes) and Appendices (Deed of Assignment Version 1 -4) have been removed in light of the position currently taken by the private insurance sector to not allow assignment of private insurance policies;
- B22 and B23 – updated disclaimer regarding New Zealand Real Estate Trust;
- Various updates to clauses that refer to repealed legislation or cross-reference clauses in the General Terms of the current Agreement for Sale and Purchase.

Overseas Investment Act update
From 22 October, overseas persons will require consent of the Overseas Investment Office to purchase residential land. REINZ will be releasing an information sheet and guidance for Members in respect of the new restrictions in early September.
Case Update: Licensee who failed to disclose interest guilty of misconduct
Facts: Licensee 1’s colleague, Licensee 2, was marketing a property. Licensee 1 brought the property to his client’s attention. The client then made an offer. The offer was passed by Licensee 1 to Licensee 2 and then onto the Vendor. The offer was accepted. Licensee 1 had no dealings with the Vendor. The client later wanted to withdraw from the purchase. Licensee 1, who was at the time looking for a property to purchase, suggested to the client that he and his wife purchase the property. Licensee 1’s wife was nominated as the purchaser. The Vendor later found out and it was discovered that no disclosure was ever made by Licensee 1 to the Vendor.
Licensee 1 accepted he did not provide an independent valuation or obtain the informed consent of the Vendor. Licensee 1 was charged. He admitted his conduct was unsatisfactory but disputed that it was misconduct.
Decision: The READT accepted that Licensee 1 did not have any dealings with the Vendor. It also accepted that Licensee 1 had no input in the negotiations leading to the agreement and therefore had no impact on the purchase price.
Notwithstanding this, the READT emphasised that obligations on licensees to obtain informed consent and provide independent valuations in situations where there are conflicts of interest are fundamental in promoting public confidence in the industry. These obligations continue after an agreement has become unconditional, until settlement.
In this case, Licensee 1 gave no thought to his obligations. This was not unsatisfactory conduct, it was misconduct. The fact that Licensee 1 had no contact with the Vendor and no input in the negotiations did not absolve him of responsibility.
