2018 Australasian Auctioneering Championships

The Australasian Championships is an annual event representing the most skilled and professional auctioneers that Australia and New Zealand has to offer.
The Championships are conducted by both the Real Estate Institute of New Zealand (REINZ) and the Real Estate Institute of Australia (REIA). REINZ is proud to be hosting this year’s event in Auckland at the Q Theatre.

Case Update: Tenants liable for exemplary damages for removing smoke alarm

Facts: The Landlord sought exemplary damages from the Tenants for removing a smoke alarm from the ceiling of the Property. The battery from the alarm was removed and the alarm was placed in a wardrobe. The Landlord also sought compensation for damage that had been caused to the Property and for chattels that had been taken at the end of the tenancy.

Decision: The Tenancy Tribunal explained that interfering with a means of escape from a fire is an unlawful act. Parliament signalled that this unlawful act was particularly serious by providing for exemplary damages of up to $3,000. The Tribunal noted that exemplary damages are akin to a fine; they are designed to punish and to deter. In deciding whether to award exemplary damages, the Tribunal must consider the intent of the person who committed the unlawful act, the effect of the unlawful act, the interests of the landlord (in this case) and the public interest.

In applying that to the facts, the Tribunal held that “removing a smoke alarm is an intentional act since the decision is one deliberately made. The effect of removing a smoke alarm is to render an important warning system for a fire inoperative. There is a strong public interest in tenants not interfering with a means of escape from fire. Taking these matters into account I award the Landlord exemplary damages of $2,000.”

Case Update: Licensee who spent night at property has license cancelled

Facts: The Licensee was discovered in an apartment which had been listed for sale with the agency that employed the Licensee. A parent of the apartment owner visited the apartment and found the Licensee, who had stayed overnight, and was using the shower. The Licensee initially explained that he had come to show the apartment to a customer and had arrived early to use the shower. He later suggested that he had nowhere to stay but another agent had told him he was able to stay at the apartment. The Licensee was charged with disgraceful conduct. He had defended the charge, but the Tribunal found that it was proven.

Decision: The READT emphasised that the focus of professional disciplinary tribunals is the maintenance of professional standards and the protection of the public. This involves an element of deterrence.

In determining the Licensee’s sentence, the Tribunal considered a number of factors. First, the extent and duration of the Licensee’s unauthorised intrusion into the property. Secondly, the extent of the Licensee’s dishonesty upon being apprehended. Thirdly, the Licensee’s apparent lack of insight into the seriousness of his conduct. Fourthly, the way in which the Licensee had treated the investigating officers of the REAA. Not only did the Licensee fail to cooperate, he was insulting and threatened legal action. The Tribunal explained that compliance by licensees with their obligations would be supported by a strong sentence. In this case, the starting point was the cancellation of the Licensee’s license. The Tribunal was not able to consider any mitigating circumstances as the Licensee did not put any forward. In any event, the Tribunal was “left with the stark realisation that [the Licensee was] simply unsuitable to be a person licensed under the Act to sell real estate.” His license was cancelled.
