Auckland City Mission CookOff Auckland City Mission

Bindi Norwell took part in the Auckland City Mission Cook Off yesterday with other business leaders, to help prepare a meal for 200 individuals in need.

Thank you so much to everyone who has shown their support so far and donated towards this great cause - funds raised will go towards ongoing emergency food packages throughout the year.

Advertising sales and listings that are not your own?

We have received a high number of complaints from members who have had their sales or listings advertised by another agency without the agency clearly and specifically stating that the sales or listings are not theirs, essentially, claiming all advertised sales and listings are their own.

We remind agents and licensees of their obligations under section 9, of the Fair Trading Act 1986 (FTA), which states that no person shall, in trade, engage in conduct that is misleading or deceptive or is likely to mislead or deceive.

When an agency advertises sales or listings which are not their own yet holds them out to be theirs, this can be misleading and deceptive conduct. This is unfair on not only the other agency but on the consumer, who is unable to identify which property was in fact sold or listed by the agency who is advertising it.

Rule 5.2 of the Professional Conduct and Client Care 2012 (Rules), stipulates that those licensed under the Real Estate Agents Act 2008 are bound by the Act, the Rules, the FTA and the Consumers Guarantees Act 1993. Therefore, you must be aware of the requirement not to make false or misleading statements in advertising.

Penalties
If you breach the Rules and the relevant legislation, a consumer or another real estate agency may take you to the Real Estate Authority, to Court or lodge a complaint with the Commerce Commission. In particular, a breach of the FTA could mean that an individual may be fined up to $200,000 and a company may be fined up to $600,00 per offence. There is no fee to file a complaint with the Commerce Commission.


Friendly reminder to our agents regarding unsolicited mail

We have recently received an increase in complaints from members of the public about agents delivering marketing materials to their letterboxes which have signs specifically stating that “No Circulars”, “No Junk Mail” or “No Unsolicited Mail” be placed in their letterbox.

It should be noted that the New Zealand Marketing Association developed a National Code of Practice for the Distribution of Unaddressed Mail in 2006.

Under the Code, a sign requesting non-delivery is defined as “any sign displayed on a letterbox requesting that unaddressed mail not be delivered to that letterbox. The working of such signs can vary, e.g. “No unaddressed mail”, “Addressed mail only”, “No junk mail”, “No circulars”, “Addressed mail and newspapers only”. All such wording conveys the same meaning and must be honoured.”

Unaddressed mail includes advertising material such as circulars, leaflets, brochures, magazine or flyers.

If a member of the public receives unaddressed mail, then they can report this to the Mailbox helpline which is run by the Marketing Association on 0800 111 081. The Marketing Association will then investigate the complaint and determine how to deal with it.

On a side note, any material delivered to a letterbox within Auckland must be delivered in line with the requirements of Clause 28 of the Solid Waste Bylaw 2012 which deals with unaddressed mail.

Penalties
The penalty for breaching the Solid Waste Bylaw 2012 is significant and may be as high as $20,000.

There are similar bylaws for different parts of the country with fines of various amounts.

It is regarded as good business practice to not deliver into mailboxes where a sign is displayed clearly indicating that the home owner does not want to receive it, not to mention, the negative PR for the agent/agency.

February Residential Property Report

REINZ released its residential property statistics for February yesterday which showed that the number of houses sold across New Zealand fell 9.5% in February.

Despite volume falls, median house prices keep rising & five regions saw record median house prices.

REINZ urges purchasers to undertake due diligence when insuring their property
