Property Management Tip - Why clean gutters before winter?
REINZ spoke with a number of guttering experts ahead of winter who noted that although there are a number of maintenance items for any property, as winter approaches one stands out - ensuring good water flow through the guttering. The difference between pre-winter and other times of year is the double trouble combination of post-autumn leaf fall and the heavier and more frequent rains of winter.
What happens when gutters get blocked?
The minimum issue is water overflow - a nuisance at best but easily a sleep depriver if it's noisily discharging outside a bedroom window. With traditional external guttering like the classic PVC, this is the usual magnitude of issues.
The more serious side of blocked guttering comes from more problematic designs, where blocked water flow tends to result in water intrusion, with water entering the roof cavity and potentially wreaking havoc with ceilings, walls, carpets and possessions.
Such designs include the notorious "internal guttering", central valleys like those common on larger villas and any flat roofed dwelling.
With the leaves of autumn upon us and the rains of winter to follow, it's a good time to assess your properties for a possible gutter clean so you, your tenants and your clients can all sleep a little better.
Case Update: Abandonment of Tenancy
The issue in this case was whether the Tenancy Tribunal could terminate the tenancy for abandonment under section 91AA of the Residential Tenancies Act 1986.
Applicable law: Section 91AA of the Act allows the Tribunal to terminate a tenancy where the premises have been abandoned by the tenant and rent arrears have accrued. A tenancy is deemed to have been abandoned, where the tenant leaves the premises without any reasonable excuse and has no intention to return or meet their obligations under the Act and fails to notify the landlord.
Facts: On 7 March 2019, the landlord became aware that the tenant was no longer residing in the premises and had essentially, abandoned the premises. The landlord had been informed by the neighbours that the tenant had left their belongings outside the property then removed them and rubbish had been left on the property.
On 8 March 2019, the landlord entered the premises which was mostly empty and had no signs of anyone living there. The landlord informed the Tribunal that the tenants were last seen collecting their belongings on 10 March 2019. After 10 March 2019, the landlord made repeated attempts to contact the tenant by phone, text, messages and emails, however, did not receive a response. The landlord provided evidence of rent in arrears.
Finding: The Tribunal found that the premises had been abandoned and that rent was in arrears and accordingly, terminated the tenancy.
