Ask Advisory: Should the Agreement for Sale and Purchase be signed by only one owner without the authorisation of the other?

Answer:
We strongly recommend against this practice because the parties could be in the middle of a dispute or separating from one another.

You should obtain written authorisation from the party who will not be signing, confirming that the signing party has appropriate authority.

Where the party signing has the authority to sign on the behalf of the other party by way of an Enduring Power of Attorney, it should be accompanied by a Certificate of Non-Revocation and Non-Suspension as proof that the authority has not been revoked or suspended as at the date of the certificate.

AML/CFT Annual Report deadline has now passed

Well done to our members for submitting their first AML/CFT Annual Report to the Department of Internal Affairs (DIA).

The information obtained from the reports will allow the DIA to have a better understanding on how businesses meet their obligations under the AML/CFT Act, assess and lessen their risk of money laundering and manage their financial activities.

It is important to note that compliance action may be taken against those who have not submitted their annual report.

DIA to provide more training workshops on AML/CFT obligations

As you might recall, DIA hosted a series of training events in June to help businesses identify what they needed to do to complete a Risk Assessment, and document an AML/CFT Programme. A number of these events booked out so the DIA are running additional sessions in September and October in the booked out locations – Wellington, Auckland, Christchurch, Hamilton and Dunedin.

These interactive sessions are designed to provide information on key factors businesses will need to consider, and answer any questions about what they need to do. This training is specific to completing risk assessment and documenting the AML/CFT programme.

These additional sessions commence at the end of September - there are no charges for attendance. Those who attended a session in June or early July will not need to attend these as the content is the same.

Registrations can be made via the DIA website.
