As you will know, REINZ has been working closely with MBIE’s Information and Education team and trust that the below information on the Insulation Regulations and Healthy Homes Standards are of assistance for our Property Management Members.
The deadline for installing ceiling and underfloor insulation has now passed (1 July 2019), and the Healthy Homes Standards have become law.
Insulation is now compulsory in rental homes
All rental properties must now have ceiling and underfloor insulation installed – where it is reasonably practicable to do so. Tenants who think their property isn’t insulated should talk to their landlords first. MBIE’s website has information about the next steps they could take.

Healthy Homes Standards are now law
The Healthy Homes Standards introduce specific and minimum standards for heating, insulation, ventilation, moisture and drainage, and draught stopping in rental properties. From 1 July 2021, private rental properties must comply with the standards within 90 days of a new (or renewed) tenancy.
While the first compliance date is two years away, there are some things landlords need to do from 1 July 2019:
- All new or renewed tenancy agreements must include a signed statement that the landlord will comply with the standards
- Landlords must keep relevant documents as evidence of compliance with the standards
- Landlords can give a minimum of 24 hours’ notice to access their rental properties for the purpose of complying with the standards.

Information Campaign
Tenancy Services is commencing a national information and education campaign in August, with a programme of seminars around the country. You will also see ads encouraging landlords to do the right thing and comply with the standards early, and showing tenants how they can keep their rentals healthy.
The Taxation (Annual Rates for 2019-20, GST Offshore Supplier Registration, and Remedial Matters) Act 2019 came into force on Wednesday, 26 June 2019.
Ring-fencing rental losses
A result of the Act being passed is that losses derived from residential rental properties will not be able to be offset against other sources of income to reduce tax.
This change is to be treated as having come into force on 1 April 2019.
IRD number on land transfer documentation
Under the Act, all buyers and sellers will be required to provide their IRD number on land transfer documentation from 1 January 2020.

MBIE has launched a new Unit Titles website to make it easier for visitors to find unit title information all in one place.

Property managers urged to consider dropping landlords who don't insulate
Bindi Norwell, REINZ Chief Executive said: "The landlord may get a fine of up to $4000 and a property manager that works with a landlord that hasn't insulated is also potentially getting a fine of up to $4000, so they're both liable."
